1. Operator and contact

Mixly is operated by Individual Entrepreneur ULADZISLAU YARMAKOVICH, Batumi, Georgia ("Mixly", "we", "us", or "our").

2. Acceptance of these Terms

By downloading, accessing, or using Mixly, you agree to these Terms of Use and to the Mixly License Agreement. If you do not agree, do not use the app.

3. Adult-only use

You may use Mixly only if you are at least 18 years old and legally allowed to view informational content related to hookah/shisha, tobacco, tobacco-free flavor products, nicotine-related products, or similar regulated goods in your location. If local law requires a higher age, you must meet that higher age.

You are responsible for complying with all laws, age restrictions, and regulations that apply to you.

4. Informational purpose only

Mixly provides informational catalog content, mix composition references, flavor categories, brand references, and recommendation-style ranking features. Mixly does not provide professional, medical, health, safety, legal, or regulatory advice.

No content in Mixly should be understood as a claim that any tobacco, nicotine, hookah, shisha, or related product is safe, healthy, risk-free, lawful for you, or appropriate for your use.

5. No sales or purchase facilitation

Mixly does not sell regulated goods. Mixly does not process orders, payments, deliveries, reservations, marketplace listings, coupons, affiliate purchases, or retail referrals for tobacco, nicotine, alcohol, or controlled products.

You must not use Mixly to buy, sell, distribute, advertise, promote, or facilitate regulated goods or illegal activities.

6. Accuracy and availability of content

Mixly content may include mix names, flavor labels, percentages, strength labels, quality scores, rankings, source references, and catalog metadata. This content is provided for general informational reference only and may be incomplete, inaccurate, outdated, experimental, or based on estimates.

We may update, remove, reorder, or change catalog content at any time. We do not guarantee that the app or any catalog data will always be available or error-free.

7. User feedback, community content, and interactions

If you send feedback, suggestions, catalog requests, bug reports, community mix suggestions, reactions, ratings, reviews, comments, or similar material, you grant us a non-exclusive, worldwide, royalty-free permission to use, review, moderate, publish, adapt, translate, analyze, and display that material to operate, improve, and develop Mixly and its catalog without compensation to you. You retain ownership of any rights you have in your submitted content.

Community mix suggestions, reactions, ratings, reviews, comments, nickname snapshots, and related metadata may be reviewed before or after publication. We may approve, reject, edit, translate, format, hide, remove, or decline to publish community content at our discretion. If you provide a nickname, it may be displayed with approved community content.

You may be able to edit or delete your own community reviews where the app provides that feature. Deletion may remove the review from public display, but backup, security, moderation, analytics, legal, or operational records may remain where reasonably necessary.

You must not send unlawful, infringing, abusive, hateful, harassing, misleading, unsafe, promotional, spammy, confidential, or third-party personal information through feedback, support, community suggestion, reaction, rating, review, or comment channels.

8. Prohibited conduct

You agree not to:

• use Mixly for unlawful purposes or to violate age restrictions or regulated-goods laws;
• use Mixly to promote or facilitate purchase, sale, distribution, or misuse of tobacco, nicotine, alcohol, or controlled products;
• scrape, copy, extract, or compile substantial parts of the catalog or database for a competing or commercial dataset;
• interfere with, overload, scan, attack, or attempt unauthorized access to Mixly, Supabase, or related infrastructure;
• manipulate, spam, automate, buy, sell, or misrepresent community reactions, ratings, reviews, comments, or suggestions;
• reverse engineer the app except where applicable law expressly allows it;
• remove copyright, trademark, or other proprietary notices;
• misrepresent affiliation with Mixly or with any brand referenced in the app.

9. Intellectual property and third-party marks

Mixly, including its app design, UI, code, catalog structure, ranking logic, text, and compiled datasets, is owned by us or licensed to us. Brand names, product names, source names, trademarks, and other third-party identifiers remain the property of their respective owners.

References to third-party brands or products are for informational identification only. They do not imply endorsement, sponsorship, partnership, authorization, or affiliation.

10. Premium features, purchases, and subscriptions

Mixly may offer premium features through in-app purchases, subscriptions, trials, lifetime access, or similar paid access options. Prices, billing periods, renewal terms, trial availability, cancellation rules, taxes, refunds, and payment methods are controlled by the applicable app store and may vary by country, platform, and offer.

Subscription purchases may renew automatically unless cancelled through your Apple App Store or Google Play account settings before renewal, according to the rules of the platform where you purchased. Mixly does not directly process card payments and does not control app store refund decisions.

Premium access may depend on third-party purchase infrastructure, including RevenueCat, Apple App Store, and Google Play. If purchase validation, restoration, or subscription services are unavailable, premium features may be temporarily unavailable until service is restored.

11. Sharing, links, and third-party apps

Mixly may let you share mixes, app links, smart links, generated share text, or generated share-card images through your device share sheet. You are responsible for choosing where and with whom you share content. Third-party apps, websites, social networks, messaging services, and recipients may apply their own terms and privacy practices.

Shared links may open Mixly, redirect to an app store, or show an intermediate page. We do not guarantee that every deep link, smart link, store fallback, share-card image, or shared preview will work on every device, platform, browser, or third-party service.

12. Translation features

Mixly may provide machine translation for community review or comment text. Translations may be inaccurate, incomplete, delayed, or unavailable. Do not rely on translations for legal, health, safety, or regulatory decisions.

13. Privacy

Your use of Mixly is also governed by the Mixly Privacy Policy, which explains how information is handled.

14. Disclaimers

Mixly is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We disclaim warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, and merchantability.

15. Limitation of liability

To the maximum extent permitted by law, Mixly and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to your use of the app.

Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Termination

We may suspend or terminate access to Mixly or any related service if you breach these Terms, create legal risk, interfere with the service, or misuse the app. You may stop using Mixly at any time and uninstall the app.

17. Governing law

These Terms are governed by the laws of Georgia, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your location require otherwise.

18. Changes to these Terms

We may update these Terms when Mixly changes or legal requirements change. The effective date will show when the latest version applies. Continued use of Mixly after changes means you accept the updated Terms.
